In July 2026, SpaceXAI sued the State of Minnesota. At the heart of the dispute? A law banning "nudification" tools software that generates intimate images from photos of clothed people, without their consent.

Minnesota is not alone. The European Union, through the AI Act Omnibus, has also banned these practices. In France, Sarah El Hairi, Secretary of State for Children, has referred the matter to the Council of State to address the explosion of AI-generated child sexual abuse material.

2. Hugging Face: The Reluctant Host

Meanwhile, an investigation by AI Forensics revealed that Hugging Face, one of the largest AI model hosting platforms, hosts nudification models accessible to anyone. These tools allow anyone, without technical expertise, to "undress" photos of people most often women without their consent.

The problem is not merely technical. It is systemic. These models were designed specifically for this purpose. The platform hosted them, made them available for download, and only removed them under media pressure.

Privacy advocates and digital rights organizations have repeatedly warned about the normalization of these tools. As French lawyer Murielle Cahen puts it, "these AI tools that undress women without their consent constitute sexual and digital violence."

3. What Is Consent Worth in the Age of AI?

We are asked for consent everywhere. Cookies, newsletters, data sharing, photo usage. Checkboxes, pop-ups, fifty-page terms of service that no one reads.

But what does "consent" really mean when an AI model can:

  • Analyze thousands of your photos to extract patterns
  • Generate images of you that you never took
  • Create a deepfake from a single public selfie

The Center for Countering Digital Hate (CCDH) documented that in just 11 days, the Grok model (xAI) generated over 3 million sexualized images from prompts that were supposedly prohibited by the platform's rules. 3 million potential violations. In 11 days.

This is not a bug. It is a failure of ethical design.
